The AKC papers will be marked limited registration for all puppies sold as pet only and papers will be held by Cajun Heritage Papillons until proof of spaying/neutering from a licensed veterinarian has been provided.
Purchaser agrees to have the puppy/dog spayed or neutered by the time the puppy is 9 months old or within 3 months of purchase for an adult. If the Purchaser does not produce veterinarian records to the Breeder that verify the puppy/dog has been spayed or neutered by the allotted time, the Purchaser is in breach of this contract. A copy of the veterinarian records or receipt of payment of spay or neuter must be provided to the Breeder.
If the Purchaser breeds or allows the puppy/dog to be bred, the Purchaser is in breach of this contract. If the Purchaser breaches this contract, the Purchaser will be subject to a $5000 fine by the Breeder. Also the Purchaser will be responsible for any and all court costs associated with this breach.

Contract term
GENERAL TERMS
Health
The sales contract is a guarantee of good health for the identified dog. Every precaution has been taken to ensure that our dog is healthy. The dog has been examined by a licensed veterinarian and has been determined to be in good health at this time. The dog has had all vaccinations as evidenced on his record. The sellers knows of no known contagious diseases that the dog has been exposed to within the past 21 days and the dog does not appear clinically ill from parasitic infestations
A 30-day guarantee for genetic or hereditary disease is provided at the time of sale. Seller will state in writing any known defects or contagious illnesses on any health records provided. Upon accepting the terms of this contract and, accordingly, providing his/her signature, the buyer shall accept all disclosed and known health concerns or defects. The guarantee stated above will not apply to these disclosed health concerns or defects.
It is recommended that the dog be taken to the buyer’s veterinarian within 48 hours of receipt by the buyer for an examination and scheduling of further vaccinations as applicable. The sellers are not responsible for any accidents or injuries, physical or internal, after the dog leaves the sellers’ care and such are not covered in the health guarantee. Failure of the buyer to notify the sellers of all health concerns within 14 business days of receiving the veterinarian’s certification of illness will result in forfeiture of rights.
Buyer:
The buyer guarantees that the dog will be cared for as appropriate to maintain a high quality, healthy, appropriately socialized dog. Papillons are family dogs and need the companionship of their “people”. Therefore, proper care does not include the puppy/dog being restricted full-time to any type of crate/pen.
Sellers:
The sellers guarantee that:
1. The dog is reasonably fit for the general purpose for which it has been sold – pet or breeding.
2. The dog will be free from any known genetic problems at the time of sale that would preclude it from living an otherwise normal and healthy life. Both the dam & sire have been checked for PRA, Luxating Patella, & heart problems.
Returns
Should the dog not meet the items enumerated in the guarantee above , the buyer shall have the option, with the agreement of the sellers, to:
A. Exchange the current dog for another of the same quality & originally purchased. Buyer must provide sufficient evidence of the problem and the sellers reserve the right to view and evaluate the puppy, or have it evaluated by a qualified professional. ( NOT APPLICABLE)
B. Return the dog, sign off ownership of AKC papers and receive a refund after the sellers resell the dog to a home of the sellers’ choice. Return and refund will be made only after sufficient evidence has been provided to the sellers to justify return and reimbursement. The dog must be returned healthy and in good physical condition as per buyers guarantee at the time of sale. The sellers must agree to a refund. Buyer will only receive refund up to the re-sale value of the dog less spay/neutering costs if warranted by sellers.
At no time is money to be refunded or exchanges offered until/unless the following requirements have been met:
1. Health Problems (contagious, infectious, genetic or hereditary): A statement from the examining veterinarian is necessary for the return of any dog. The statement shall include the name and address of the veterinarian, name of the dog, owner’s name, date of the exam, precise findings, and treatment recommended, and cost estimate. Statement must be presented to the sellers within 14 business days of receiving the veterinarian’s statement. The sellers reserve the right to have said dog examined by a second veterinarian of sellers’ choice. Sellers will pay for veterinary consultation for sellers’ veterinarian, but will not be responsible for expenses to buyer’s veterinarian. Should conflicting diagnosis result, a third separate opinion will be made with the cost to be shared equally between the buyer and the sellers.
2. Can Not Keep: In the event the buyer, at any time in the future, is unable to care for the dog for any reason, or no longer wants the dog, he/she agrees to immediately contact the sellers. The sellers has the first option to accept the return of the dog at no charge to the sellers, or act as an agent to place the dog in another good home. At no time will the animal be sold or rehomed without receiving the express written consent of the sellers prior to resale or placement unless the dog is being returned to the sellers.
3. Buyer’s Guarantee: The buyer has fulfilled their guarantee of maintaining a healthy, well-socialized animal.
Contract Amendment
Any changes or additional terms to this agreement must be in the form of an Addendum and be signed by all parties.
